LOYALTY PROGRAM TERMS AND CONDITIONS

Introduction

  • The following customer loyalty program ("Program") is offered by Decathlon Sports Switzerland SA ("DECATHLON"), headquartered at Route de Meyrin 171, 1214 Vernier, Switzerland and registered in the Commercial Register under number CHE-106.127.042.
  • DECATHLON is part of the Decathlon group, controlled by Decathlon SE, a company registered with the RCS Lille Métropole, in France, under number 306 138 900, and headquartered at 4 Boulevard de Mons, 59650 Villeneuve d'Ascq, France.
  • By joining the Program, you agree to abide by the Program's general terms and conditions ("CGP").

1. Who can join the Program?

  • The Program is open to any individual of legal age, fully capable of discernment, residing in Switzerland and acting in a personal capacity, in his or her own name and for his or her own account. They must also have a valid e-mail address and cell phone number, which they use in their own name and for their own account.
  • Legal entities, companies, businesses, groups, organizations, associations and any other grouping carrying out wholesale purchases or for commercial purposes are excluded from membership of the Program.
  • Membership may not be used for resale or other commercial purposes.

2. How to join the Program and become a Member

  • The Program is a feature of the DECATHLON account system. To join the Program and become a Member, you must create a DECATHLON account. This can be done online at www.decathlon.ch and on the DECATHLON Shopping application, or in person at one of our DECATHLON stores in Switzerland.
  • All DECATHLON accounts active on December 22, 2023 will be automatically updated with the Program on that date, so that account holders will automatically become Members on that date. DECATHLON accounts held for commercial purposes and/or bulk purchases ("B2B accounts") are excluded; these will remain in existence but will not be eligible for membership of the Program.
  • Membership of the Program is free of charge and subject to no purchase obligation. Internet and/or mobile data connection costs that may be incurred when accessing and using the www.decathlon.ch website and/or the DECATHLON Shopping application are the sole responsibility of the Member.
  • Only one DECATHLON account is authorized per person. The DECATHLON account may only be used by the Member in his/her own name and for his/her own account and may not be transferred to a third party. In case of doubt, DECATHLON reserves the right to request proof of identity to verify the Member's identity. In the event of unsatisfactory verification of identity, DECATHLON may decide not to grant Points or other benefits related to membership in the Program.

3. What information do I need to join?

To create a DECATHLON account, you must fill in the following mandatory fields:

  • First name ;
  • Surname ; Last name ;
  • Valid e-mail address;
  • Valid cell phone number.
As a Member, you will be responsible for the truthfulness and accuracy of the information you share with DECATHLON.

4. What are the benefits of the program?

4.1 Membership Card

  • An electronic Membership card will be sent by email to each new Member following registration. The card can also be viewed via the DECATHLON Shopping app and on the website www.decathlon.ch. The Membership card may only be used by the Member in his or her own name and for his or her own account and may not be transferred to a third party. The Member may not offer, give, or lend it to a third party. Each Member agrees to use it in accordance with the General Terms and Conditions.
4.2 Return Policy
  • Members may benefit from DECATHLON's 365-day return policy, as defined in DECATHLON's General Terms and Conditions of Sale.
4.3 Collection of loyalty points
  • Members earn 10 loyalty points (“Points”) for each Swiss franc (CHF) spent on: the purchase of new products, sold and/or shipped by DECATHLON in one of the participating DECATHLON stores, on the website www.decathlon.ch or on the DECATHLON Shopping application.
  • Members earn 20 Points for each Swiss franc (CHF) spent on: the purchase of Second Life products sold and/or shipped by DECATHLON in one of the participating DECATHLON stores, on the website www.decathlon.ch or on the DECATHLON Shopping application, for the rental of products in one of the participating DECATHLON stores; and/or for the repair of products in one of the participating DECATHLON stores.
  • The products listed above whose purchase generates Points are hereinafter defined as “Loyalty Product(s)”. The purchase of DECATHLON products sold through a channel other than those indicated above, the purchase of DECATHLON gift cards, and delivery charges are expressly excluded.
  • To enable the collection of Points online, each Member must log in to their DECATHLON account.
  • To enable the collection of Points in participating DECATHLON stores, the Member must either scan their Member card at the checkout or present it to a DECATHLON store employee at the time of purchase. Retroactive allocation of Points after payment at the checkout is excluded.
  • If the Member returns a Loyalty Product and requests a full or partial refund from DECATHLON, the Points corresponding to the refunded amount will be deducted from the Member's Points balance. If the Points balance is insufficient following the deduction, the balance will be updated with a negative figure.
  • Points are personal to the Member and non-transferable.
  • Points can be collected as soon as a Member joins the Program. Retroactive awarding of Points for purchases of Loyalty Products, rental or repair made before the Member joined the Program is excluded.

  • Accumulated Points are valid for a period of 12 months from the day they are collected. DECATHLON may set a shorter validity period for points that members receive as part of special promotions.
4.4 One-off offers and short-term missions
  • As part of special promotions, members can collect additional points or receive them as a gift from DECATHLON.
4.5 Converting Points into a voucher
  • Each Member who has accumulated 3000 Points has the option to convert these Points into a DECATHLON electronic voucher worth CHF 5, valid for 6 months from the date of issue.
  • To convert Points into a voucher, the Member must log in to their online DECATHLON account and follow the instructions provided in the Points section. The voucher is issued electronically within minutes of the completion of the conversion procedure and can be used as soon as it is issued.
  • The voucher is personal and non-transferable. Only the Member who has converted their Points into such a voucher can use it, and this, for a purchase in their own name and for their own account.
  • The voucher can be used for Loyalty Products, either online on the website www.decathlon.ch and/or on the DECATHLON Shopping application, or in participating DECATHLON stores, indicating the Member's DECATHLON account each time. The voucher cannot be used retroactively.
  • The voucher can only be used in its entirety and for a single transaction. When using the voucher, the amount of the voucher is deducted from the transaction amount, thus reducing the amount of the transaction to be actually paid by the Member and automatically resulting in the cancellation of the voucher. If the transaction amount is less than the voucher amount, the unused balance of the voucher will be forfeited; DECATHLON cannot be held liable for any loss and declines all responsibility for any damage of any kind.
  • The voucher cannot be exchanged for cash or used to purchase a gift card. 
4.6 Other benefits
  • DECATHLON may, from time to time and at its sole discretion, offer other benefits and advantages to Members and reserves the right to modify the GTC accordingly.
  • These benefits are subject to the GTC and the terms of DECATHLON's partners.
4.7 Personalized offers
  • Members will receive personalized offers from DECATHLON if they have opted in to receive email communications and marketing information from DECATHLON. These personalized offers will include important information about the lifecycle of their Points and rewards, as well as special communications for benefit updates.

5. What happens in the event of fraudulent use of the Program?

  • Members who become aware of suspicious or fraudulent activity related to their Program membership account and/or Member Card must notify DECATHLON immediately, failing which such activity will be attributed to the Member directly on the grounds specified in the paragraph below.
  • If a Member does not comply with these GTC, uses the Program in bad faith or if DECATHLON detects fraudulent use of the Program by the Member or by a third party, DECATHLON reserves the right to cancel the respective Program membership at its sole discretion. Consequently, the Member will no longer be able to benefit from the Points acquired during his/her membership in the Program. DECATHLON declines all responsibility for any loss and/or damage of any nature whatsoever.

6. How is your personal data processed?

DECATHLON processes your personal data in accordance with the Personal Data Management Policy.

7. How can I update my personal information?

Each Member is responsible for the truthfulness and accuracy of the personal data they share with DECATHLON. Members can update their information by logging into their DECATHLON account on the www.decathlon.ch website.

8. What should I do if I have a question or wish to make a complaint?

If you have any questions or complaints about your membership, please contact our customer service department via our website or by e-mail at [email protected].

9. Can I unsubscribe from the program?

  • The Program is a free service associated with the DECATHLON account. Members wishing to unsubscribe must delete their DECATHLON account by contacting our customer service department via the website or by e-mail at [email protected].
  • As soon as you unsubscribe from the Program and delete your DECATHLON account online, your Points and benefits will be permanently deleted, with no possibility of recovery.

10. End of program

  • DECATHLON reserves the right to terminate the Program in its entirety and at its sole discretion, at any time and without giving reasons. DECATHLON will make reasonable efforts to inform all affected Program Members in advance. In the event of termination of the Program, all Points will be permanently lost, with no possibility of recovery or compensation by DECATHLON.
  • DECATHLON may, at any time, refuse to create, remove, cancel or terminate an individual DECATHLON Membership account and/or remove an Account Holder where DECATHLON reasonably believes that the account and/or Account Holder has been associated with theft, misconduct, abusive or offensive behavior, or the provision of false or misleading information to DECATHLON.

11. Amendments to the GCP

  • Members are advised to check these CGPs regularly.
  • DECATHLON reserves the right to modify them at any time without notice. Any substantial modification will be communicated to Members in advance within a reasonable period of time.
  • Members shall accept all modifications to these GPC if they continue to use the Program.

12. Liability

  • To the extent permitted by law, its representatives, distributors and subcontractors shall in no event be liable or obligated to indemnify Members or accept any liability for any loss, damage, injury or death arising out of membership in the Program.
  • DECATHLON reserves the right to temporarily interrupt access to the Program for maintenance purposes.
  • DECATHLON may not be held liable for the non-performance or delay in the performance of a service of the Program due to circumstances, difficulties or temporary impossibility of access to the Program caused by circumstances beyond its control due to disruptions of telecommunications networks or a case of force majeure having the effect of modifying these GCP.

13. Other terms and conditions

  • All orders for products and/or services on the website www.decathlon.ch, on the DECATHLON Shopping application or in DECATHLON stores are subject to the General Terms and Conditions of Sale.
  • All access to and use of the www.decathlon.ch website and the DECATHLON Shopping application are subject to the General Conditions of Use.

14. Miscellaneous provisions

  • These GCP comprise all the clauses of which they are composed. They may not be modified without the express written consent of DECATHLON.
  • Failure to invoke any of the clauses herein at a given time shall not constitute a waiver of the right to invoke the same clauses at a later time.
  • If any provision of these GCP is declared invalid or ineffective by application of a law, regulation or following a final judicial or administrative decision, the other provisions shall retain their force and scope. DECATHLON will replace the provision in question with another that is valid and similar in scope to the spirit of the present terms and conditions.
  • These GCP are governed by Swiss law, to the exclusion of conflict-of-laws rules or principles of international private law. The Parties expressly exclude the application of the Vienna Convention on the International Sale of Goods to their relationship. Any disagreement, claim or dispute arising out of or in connection with these T&C or your membership shall be resolved before the competent courts of Switzerland.
