Guarantee modality

The following applies to our products: 1. Basis for claims: Liability for material defects (Sections 434–443 of the German Civil Code (BGB)) The statutory warranty – also known as ‘liability for material defects’ – regulates what we as the seller are liable for to the buyer if a product is defective upon delivery. According to § 434 BGB, a material defect exists if the purchased item does not have the agreed quality, has defects or does not have the usual quality. 2. Duration of the warranty: 2 years (Section 438 (1) No. 3 BGB) For new goods, the statutory warranty period is 24 months from delivery. The buyer can assert claims for defects within this period. 3. Reversal of the burden of proof: 12 months (Section 477 BGB – since 2022) The following applies to purchases of consumer goods: In the first 12 months after delivery, it is assumed that the defect already existed at the time of delivery. The seller must prove that the defect was caused by improper use. Note: Before 1 January 2022, this period was six months. 4. Rights of the buyer in the event of defects (Section 437 BGB) If a defect is established, the buyer has the following rights: Subsequent performance (Sections 439, 440 BGB): Choice between repair or replacement delivery. Withdrawal or reduction (Sections 441, 323 BGB): If the subsequent performance fails twice or is refused. Compensation (§ 440 BGB, § 280 ff. BGB): In the event of fault on the part of the seller. 5. Costs of subsequent performance (§ 439 (2) BGB) We bear all costs for shipping, transport, labour and materials. The buyer shall not be left to bear the costs themselves. 6. No exclusion of warranty for new goods (Section 476 (1) BGB) The statutory warranty for new goods cannot be excluded or shortened in B2C trade.
